Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS BEFORE USING OUR WEBSITE.  FIRST COIN COMPANY RESERVES THE RIGHT TO UPDATE THESE TERMS AND CONDITIONS PERIODICALLY, FROM TIME TO TIME, SO PLEASE CHECK THESE TERMS AND CONDITIONS FROM TIME TO TIME.
 

1.    OWNERSHIP

First Coin Company, Inc. (“FCCI”) is a direct distributor and sells coins of various national mints only in bulk.Determination of the required minimum size of any order is within FCCI’s discretion.  FCCI makes that determination based on the type of coins sought for purchase and the availability thereof from the issuing countries’ national mints.

FCCI is not a retailer.  It is a wholesale distributor of coins issued bysome of the largest mints in the world.  FCCI does not maintainasizeable inventory of coins and its ability to accept and fill orders is based on the availability of coins for order and delivery from the issuing countries’ national mints.

2.    SELECTION

All orders from FCCI require one hundred percent prepayment.  Shipment of your order will not occur, and title to the items comprising your order from FCCI shall not pass to you, until your order has been paid for in full. Payment for coins and/or other products ordered from (FCCI) shall be made by wire transfer to FCCI’s U.S. bank account, in U.S. dollars.

FCCI’s policy is to issue an invoice to the ordering clientprior to the shipment of any order. The invoice shall be sent to the ordering client by e-mail directed to the e-mail address provided by the ordering client at the time of registration of the ordering client’s account with FCCI.  Each invoice will contain shipping and payment information, including theaddress to which the order is due to be shipped.  Orders will be sent only to the shipping address statedthe invoice.  It is the ordering client’s responsibility to carefully check each invoice and alert FCCI of any errors therein prior to the shipment date.  FCCI disclaims all liability for errors in shipment resulting from the orderingclient’s failure to notify FCCI of required corrections to the shipment address and/or other information stated in FCCI’s invoiceprior to shipment.   

Each invoice shall include amounts required to cover shipment and delivery of the ordered products described in the invoice.  In the event the requested delivery address is located within the United States, Canada, Australia, New Zealand, andEuropean Union countries, shipment and delivery may be made to a specific business or residential address. In the event the requested delivery address is located within Russia, Ukraine, Belarus, Kazakhstan, Azerbaijan,Georgia,Armenia, Uzbekistan, Turkmenistan, Kyrgyzstan,Moldova, Mongolia, and/or Israel, deliveries to those countries may only be made to the location of a major airport closest to the requested delivery address, and must be picked up by the ordering client from such airport location.

Any and all taxes, fees,customs duties, VAT, and any other similar taxes or fees required to be paid to any government agencies at any place of destination outside the United States are the sole responsibility of, and are payable solely by, the ordering client at the ordering client’s sole cost and expense exclusive of and in addition to the amounts stated in FCCI’s invoice.  Such amounts shall not be included or reflected in the price of the products (coins) and/or the price of shipment and delivery stated in FCCI’s invoices.  FCCI is not liable for additional taxes, customs fees, or other charges or assessmentsthat may be imposed by customs agencies in the countries to which shipments are deliverd.

All requests for correction of errors of shipment and delivery information, and prepayment in full of the amounts due stated in any invoice, must be made by the ordering client and received by FCCI within two (2) business days from the date that FCCI transmits the invoice to the ordering client by e-mail. 

In the event prepayment in full for any order has not been received by FCCI within two (2) business days from the date of e-mail transmission of any invoice to the ordering client, the order to which the invoice relates may be suspended or canceled.  In the event an order has been canceled by FCCI due to the ordering client’s failure to prepay the required amount within two (2) business days in the manner provided in these Terms and Conditions, the products described in the ordermay be re-ordered by placing a new order with FCCI.

The payment of any bank charges or fees and/or related taxes or similar charges required to transfer payment funds to FCCI shall be the ordering client’s sole and exclusive responsibility. 

Once prepayment in full has been made by the ordering client and received by FCCI, shipment of the order shall occur in due course using FCCI’s ordinary procedures for filling and shipping orders.  The coins sold by FCCI are ordered from nationalmints after receipt of prepayment in full for the order from the ordering client.  Orders for bullion coins are ordinarily delivered to the ordering customer at the designated shipment destination within a period of thirty(30) calendar days from the date of receipt of prepayment. 

The prices of the coins and other products offered for sale on FCCI’s website fluctuate on account of fluctuationsin the prices of precious metals and related market conditions.  Placing an order for coins and other products fixes the price of that order to the ordering client temporarily for a period of two (2) business days or until payment for those products has been received from the ordering client, whichever occurs earlier.  Once the ordering client has made full prepayment, the price of the order will be deemed final and will be confirmed in the invoice e-mailed to the ordering client prior to shipment. Prices listed on the invoice arefinal as of the date of the invoice and not subject to increase on account of changes in the cost of precious metals, theintroduction or abolition of applicable taxes, or other similar circumstances will not constitute a change in the price of the products.

FCCI shall notify the ordering client by e-mail in the event prepayment in full has not been received within two (2) business days in accordance with these Terms and Conditions.  In the event any ordering client fails to prepay in full the amount of any order within two (2) business days, and this occurs more than once in any calendar year, FCCI may, in its discretion, bar that client from placing any more orders with FCCI for the remainder of the calendar year in which suchmultipleinstances of failure to prepay occur.

Many national mints that supply FCCI set quotas or other restrictions on the number of certain coins that may be ordered by distributors.  In addition, certain coins may become unavailable for other reasons that are beyond FCCI’s control.  In the event FCCI is unable to fill an order on account of the operation of quota limits or other restrictions, or because any ordered coin has become unavailable and can no longer be ordered, FCCI reserves the right to cancel the order and make full refund of the prepayment funds received from the ordering client.  Alternatively, FCCI may offer the ordering client a substitution of similar kind and value.  The acceptance of any offer of substitution by FCCI shall be solely within the ordering client’s discretion. 

FCCI shall issue a written confirmation of shipment by e-mail to the ordering client upon shipment of the ordering client’s order.  This ordinarily occurs on the day of shipment.  The written confirmation contains allnecessaryinformation regarding the status of the order, includinga control number that can be used totrack the movement and delivery status of the order on the shipping company’s website.

More information regarding FCCI’s procedures for the shipment of orders may be found on FCCI’s website, in its “Delivery” section, which may be reached at the following link:www.firstcoincompany.com.  FCCI delivers only to the countries listed in that section; provided, however that special shipping to other countriesnot specified in the “Delivery”section may be organized in certain cases, in FCCI’s discretion.  Please check with us regarding delivery matters if you wish to organize delivery to countries not on FCCI’s delivery list.

Investment coins are not eligible forrefund or exchange as per FCCI’s return and exchange policy, which is available at the following link: www.firstcoincompany.com.

FCCI is not responsible for delaysin delivery of orders due to customs control issues, or on account of the acts of government agencies with authority over the order in the countries of destinationto which delivery of orders takes place.

These Terms and Conditions can be changed by FCCIwithout prior notice to FCCI’s clients.  Please check this page from time to time to track changes in the terms and conditions.
